Having been employed at Eugene Scalia's then-law firm at the time, I can tell you that it was well known his compensation excluded any draws based on the firm's Supreme Court practice (which was and is substantial). Because there was no financial benefit to the son, the father was not required to recuse himself. (BTW, I never met Gene, who was based in a different office.)
